Betul_fit Lifestyle is a business in the retail industry that supplies healthy foods, supplements, clothing and beauty related products to the public and industry professionals. Guarantees or warranties are provided in respect of certain goods as per Betul_fit.

Delivery policy

Subject to stock availability and receipt of payment, online orders will be processed and delivered with 3 to 5 working days and delivery confirmed by way of a tracking number. Betul_fit utilises a courier service for deliveries and the associated costs pertaining to any delivery will be indicated as the “Shipping” charge on your order. Delivery to outlying areas may have an extended delivery time and higher charge. Betul_fit obligation to deliver an item is fulfilled when it delivers the item to the physical address nominated by the customer for delivery of the order. All risk of damage or loss and title for such item shall pass to the customer upon delivery by Betul_fit to the courier.

Export restriction

The offering on this website is available to South African clients only, for delivery in South Africa only.

Availability and Pricing

The provision of goods and services by Betul_fit is subject to availability. In cases of unavailability, Betul_fit will refund the payment received from the customer in respect of such goods or services within 30 days. Prices and specifications reflected on this website are subject to change without notice.

Cancellation policy

Cancellation of orders by the customer may be done prior to the dispatch of the item, but will attract a 2% administration fee on the total order value. Once the item has been delivered to the courier by Betul_fit, there may be no cancellation of the order by the customer (See Exchange, Returns and Refunds policy below).

Betul_fit reserves the right to cancel an order for which payment has already been received. This may occur if stock is insufficient or the quality of goods ordered does not meet the Provider’s standards. Should the Provider exercise this right, the User will receive a full refund with no deductions.

Exchange, Returns and Refunds policy

Betul_fit will exchange goods (including defective goods, subject to the Delivery policy above) within 7 working days of purchase provided that (i) the customer has returned the item for receipt by Betul_fit within the said time period, together with the original proof of purchase document and (ii) the item is in an unused, undamaged condition and the packaging is not damaged. Under no circumstances will Products that have been unpacked, or used be accepted for return or credit, it being your responsibility to inspect the Products immediately upon delivery (and most importantly prior to the use of the Products). Digital Products are deemed “used” after download or opening. Betul_fit does not allow returns or exchanges for any purchases of digital Products.

Betul_fit does not offer cash refunds. The customer will be required to select item/s to the value of the returned item/s. The customer is responsible for any and all delivery charges involved in the return and exchange process or, alternatively, can request a voucher. The new item/s will only be delivered to the courier or released to the customer once the returned item (together with supporting documents) and payment in full of all delivery charges associated with the exchange have been received by Betul_fit. Title of the returned item will only pass to Betul_fit upon receipt thereof.

Ownership and Risk 

Ownership of all Products is retained by Betul_fit until payment has been made in full, upon which ownership will pass to you.
Once the purchase price for the Product has been paid, and the Product delivered to you, ownership and risk in the use of the Product will pass to you.

Intellectual Property

The contents of this Website may not be transmitted, transcribed, reproduced, stored or translated into any other form without the prior written permission of Betul_fit.
No other use of this Website is permitted. Without restricting the generality of the foregoing, you may not make commercial use of the content of this Website, include the content of this Website in or with any product that you create or distribute, or copy the content of this Website onto your own or another’s website, unless as set out in these terms and conditions. Customers are not allowed to copy, distribute, share and/or transfer the product/s (and/or their associated username/passwords) they purchased to any third party or person.

Customer privacy policy

Betul_fit shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA).

Payment options accepted

Payment may be made via Visa, MasterCard SID via Payfast &/or yoco.

Credit card acquiring and security

All online credit card payments are processed by the PayFast Internet Payment Gateway. Card Holders may go to www.payfast.co.za to view PayFast security policies and www.yoco.com to view Yoco security polocies. 

Customer details separate from card details

Customer details will be stored by Betul_fit separately from card details which are entered by the client on PayFast/Yoco secure site.
The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction Currency is South African Rand (ZAR).

Responsibility

Betul_fit takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

Country of domicile

This website is governed by the laws of South Africa and Betul_fit chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature, 3 Princess Place, Parktown, Johannesburg, South Africa.

Variation

Betul_fit may, in its sole discretion, change this agreement or any part thereof at any time without notice. These terms and conditions are effective from 22 June 2020.

This website is run by Betul Hayriye Onugoren (PTY) LTD (Registration Number 2020/119720/07) based in South Africa, trading as Betul_fit. Directors are Betul Hayriye Onugoren Seedat.

Disclaimer Warranties and Liability and Indemnity

For the purposes of this clause “damages” means and includes:
all losses, liabilities, and damages relating to or arising from these Terms or the Services, howsoever arising, whether out of breach of express or implied warranty, misrepresentation, negligence, vicarious or strict liability, in delict or otherwise, and whether foreseen or not; and by placing an order on the website you agree in the fullest extent permitted by applicable law, that you shall have no claim whatsoever against Betul_fit, and the you hereby agree to release, indemnify and hold harmless the Betul_fit from and against any and all loss, damage, actions, proceedings, claims and demands (including, without limitation, any action, proceeding, claim or demand instituted or made by any customer or other person whomsoever) and legal and other costs and expenses (including legal costs on an attorney and own client scale) of whatsoever nature and howsoever arising (including, but not limited to, in connection with or arising from injury or death or any loss of or damage to its or any other person’s property) which you or any other person may incur or suffer arising from the use of the products or matters connected therewith or related thereto.
